A BOA-FÉ QUEBRADA: A HIPERVULNERABILIDADE DO CONSUMIDOR COM TRANSTORNO DO ESPECTRO AUTISTA (TEA) E A RESPOSTA CORPORATIVA NA SOCIEDADE DE CONSUMO – UM ESTUDO DE CASO
This article analyzes, through a case study, the violation of the rights of consumers with Autism Spectrum Disorder (ASD), classified as hyper-vulnerable. Based on a real event of a telecommunications service failure, it investigates how corporate negligence, even after the consumer’s explicit communication of their disability, transcends a mere contractual breach. The central problem questions whether such conduct constitutes a qualified breach of the principle of objective good faith and a form of systemic discrimination. The hypothesis is that the failure is not an isolated error but a symptom of exclusionary corporate structures. The objective is to demonstrate that the legal protection for these consumers requires a broader interpretation, with remedies of a pedagogical and anti-discriminatory nature, paving the way for future doctoral-level research.
