Rehabilitasi Anak sebagai Pelaku Pembunuhan dalam Islam: Kajian terhadap Konsep Ta'zir sebagai Sarana Edukasi
Rehabilitation of child criminals in Islam can be carried out through the ta'zir approach, which is a form of punishment that gives authority to leaders or judges to determine the type and form of punishment based on considerations of wisdom and societal well-being. This research applies a qualitative framework grounded in literature study to explore the concept of rehabilitation of child criminals in Islam through the ta'zir approach as an educational instrument. Data were obtained from various academic literature accessed through Google Scholar, including scientific journals, repositories, e-books, and relevant Islamic legal documents. Data sources include journal articles and previous research results that discuss Islamic law related to child criminals, as well as the implementation of ta'zir in the context of education and rehabilitation. In Islamic law, children who have not reached puberty are not subject to qisas or hudud punishments. Instead, more flexible and educational sanctions are imposed, such as warnings, advice, or guidance. This approach reflects the humanistic and compassionate principles of Islam, with the hope that the child can improve his or her behavior and reintegrate into society as a better individual.
