Collective Forestry System Reform under the Background of China’s Carbon Emission Target
Abstract The carbon reduction process expected by China’s “double carbon” goal is not completely consistent with the conceptual basis and legal system of the traditional collective forest ownership reform, and the problem of the decentralization of the main body of forest ownership has hindered the realization of China’s forestry reform goal in the new era. The realization of carbon peak and carbon neutrality needs to reshape the concept of rule of law, clarify the forestry property rights system, improve the forest rights transfer market, optimize the management form, and incorporate the sustainable management model into the forestry management system. Clarify the dual functional relationship between the “double carbon” goal and the reform of the collective forestry system, re-examine and recognize the two, organically combine scientific theoretical basis with advanced legal principles, and adhere to the distribution justice to balance the distribution of rights and responsibilities. Use the concept of green politics and ecological ethics to make up for the inherent defects of the forestry market and realize the coordinated development of forestry economy and ecological benefits at the legal system level.
