Pravne posledice radnji na elektronskim javnim prodajama

This study investigates the legal consequences of neglecting to undertake appropriate actions when using the “eAuction” information system for electronic public sales in enforcement proceedings. After more than four and a half years of mandatory application in enforcement procedures, with over 4,000 users and nearly 125,000 organized public sales, a substantial practice has developed among authorities, public bailiffs, and courts. This practice is analyzed in the present paper. Compared to existing regulations and guidelines, it provides more precise answers to practical questions related to system usage, as well as to contentious legal issues arising from errors or omissions in conduct.
