Forensic psychological expertise of moral damage: assessing psychological impact and fair compensation expertiza psihologică
Moral damage represents a violation of non-patrimonial personal rights, directly affecting an individual's psychological well-being. In accordance with Moldovan legislation, it encompasses both physical and psychological suffering, as well as a diminished quality of life. Forensic psychological expertise plays a crucial role in evaluating the severity of such harm, identifying significant psychological distress, and establishing a causal link between the perpetrator's actions and the claimant's emotional suffering. This study examines the forensic psychological assessment of moral damage, with a particular emphasis on its psychotraumatic effects. Core symptoms such as chronic stress, anxiety, fear, shame, and persistent affective disturbances are analyzed. The research also highlights relevant assessment strategies, including the examination of distressing emotional experiences, alterations in subjective well-being, and disruptions in psychological functioning. The findings point to the urgent need for standardized forensic psychological protocols to ensure systematic and objective evaluations. Special attention is given to the correlation between experienced suffering and measurable psychological indicators. Furthermore, the study stresses the importance of a comprehensive analysis of the claimant's personality and the traumatic event's repercussions on their social and professional life. Implementing a standardized methodology enhances the objectivity of judicial decisions and contributes to the equitable determination of compensation.
