Postępowanie apelacyjne w sprawach rejestrowych – zagadnienia wybrane

This article examines the specific nature of appeal proceedings in registration matters, with particular emphasis on the distinct legal solutions concerning the preparation of statements of reasons for decisions by the registry court, the specific requirements for filing appeals via the ICT system in certain cases, and the unusual scope of the appellate court’s jurisdiction in such proceedings. The issue of gravamen in registration proceedings is also addressed. Furthermore, the article discusses how an appellate court should adjudicate an appeal against a decision of the registry court where the applicable regulations do not require a written statement of reasons, both in the absence of a request for such reasons and in situations where the merits of the first-instance decision must nonetheless be assessed without them.
