Osobiste świadczenie pracy w dobie sztucznej inteligencji

The development of artificial intelligence poses a significant challenge for contemporary labor law. It influences both the organization and the performance of work. Growing reliance on, or substitution of, employees by AI systems raises important questions. These concern the compatibility of such practices with the key features of the employment relationship, especially the employee’s obligation to perform work personally. Under the current legal framework, AI is not considered an employee or a substitute for one. It is seen as a tool, permissible as long as labor law provisions and internal regulations are followed. The use of AI without the employer’s consent may cause legal risks. These include issues with personal data protection and copyright. Clear organizational and legal policies must guide AI use in the workplace. In the future, labor law may require amendments to reflect the digital work environment and growing automation.
