Przegląd orzecznictwa Sądu Najwyższego (czerwiec–sierpień 2025)
The resolution of the Polish Supreme Court of July 11, 2025 (case file no. III CZP 10/25) is of utmost importance for legal practice. In the resolution, the Polish Supreme Court assumed that a certified copy of a document, attested as a true copy of the original by a notary, may not serve as the basis for an entry in the land and mortgage register. Another important resolution of the Polish Supreme Court is the resolution of July 3, 2025 (case file no. III CZP 11/25). As indicated by the Supreme Court, an attorney’s fee for conducting a case includes representation of the party in security proceedings. A further significant resolution is that of the Polish Supreme Court of July 17, 2025 (case file no. III CZP 8/25). In this resolution, the Polish Supreme Court held that if an application for interim relief is decided within the main proceedings, the recoverable litigation costs do not include a separate attorney’s fee for representation in the interim relief proceedings.
