Czy umowa deweloperska jest umową nazwaną w świetle nowej ustawy deweloperskiej?
This article presents a number of arguments in favor of recognizing the development agreement as a named contract in the legal form introduced by the new Act of May 20, 2021 on the Protection of the Rights of the Purchaser of a Dwelling or Single-Family House and on the Developer’s Guarantee Fund. The analysis is preceded by an overview of the existing views on the legal nature of the former Development Act. According to the author’s position, the development agreement should be regarded as a distinct type of contractus nominatus, a view also confirmed by the legislator’s explicit position expressed in the justification of the draft of the new Development Act and supported by some representatives of legal doctrine.
