ANÁLISE DE CASO: OS IMPACTOS DAS CONDENAÇÕES DO BRASIL NOS PROCESSOS DAMIÃO XIMENES LOPES E GOMES LUND NA CORTE INTERAMERICANA DE DIREITOS HUMANOS
The notability of the American Convention on Human Rights, developed within the scope of the American regional system, comes not only from its geographical scope, but also from its catalog of rights and the structuring of a system of supervision and control of the obligations assumed by States. The Federative Republic of Brazil has been one of the States Parties to the American Convention since 1992, recognizing the jurisdictional jurisdiction of the Court in 1998. From that moment on, all the jurisprudence of this international court influences our legal order, especially in cases in which the State condemned is Brazil. In this sense, the purpose of this article is to analyze the development of the inter-American regional system in the face of the convictions of the Brazilian State before the Inter-American Court of Human Rights, and the impacts of the convictions domestically.
