Pursuant to Article 20 of the Misdemeanor Law No. 5326, if an administrative fine is not imposed and notified by the end of the calendar year following the date on which the act requiring an administrative fine, as specified in the Highway Traffic Law No. 2918, was committed, no administrative sanction decision can be made, and any issued decisions are nullified. The notification and issuance periods for traffic fines have been determined to be quite long, potentially extending up to twenty-four months. In previous periods, these periods were regulated as 7 and 10 days respectively by regulations. Subsequently, the time period was set quite long by law, leading to various potential problems. The long notification period for traffic fines poses a risk of failing to achieve the intended benefits of administrative sanctions and may lead to other issues. This article examines the possible problems arising from the long notification period and attempts to propose solutions.
