Z problematyki utworzenia rządu federalnego w Austrii. Rozważania na tle najnowszych doświadczeń ustrojowych
On the Issue of Establishing the Federal Government in Austria. Considerations Against the Background of the Latest Political Experiences The article presents an analysis of the procedural aspects of the formation of the federal government in Austria. A specific feature of the procedure for the formation of the Austrian cabinet is its maximum deformality. It is manifested in the almost complete freedom of the Federal President to choose the Chancellor, who presents the composition of the future cabinet. The parliament is excluded from the procedure for appointing the government. Parliamentary investiture is implied. The government’s support from the majority of the deputies to the National Council can be verified by a possible vote of no confidence. Analysing the circumstances of the formation of Christian Stocker’s cabinet (2025), the author points to the decisive role of parliamentary factions in the process of forming the government. The new government was formed by three parties (ÖVP, SPÖ and NEOS), which is a new quality in the political system of Austria.
