This study aims to (1) examine the form of criminal acts of illegal C mining from a legal perspective, (2) examine criminal liability for companies that carry out mining activities without a permit, and (3) analyze the law enforcement process against companies that have illegal mining. The research method used is empirical legal research with a descriptive nature. The results of the study indicate that (1) illegal C mining is a form of illegal mining that is considered a criminal act; (2) criminal liability by the perpetrator company can be in the form of imprisonment or a fine; and (3) the law enforcement process against companies that carry out illegal mining is carried out comprehensively by the Police starting from the investigation stage. In addition, the Police have made law enforcement efforts through investigations, arrests, confiscations, and submission of case files to the prosecutor. However, the existing process is not optimal because it only targets mine workers and has not focused on companies that own capital. This study concludes that companies carrying out illegal C mining must be prosecuted because it is unlawful. However, the law enforcement process is still not running optimally.
