The Impact of the Jurisprudence of the Court of Justice of the European Union on the Harmonisation of Albanian Legislation on Commercial Companies: A Comparative Law Analysis

This comprehensive study examines the profound impact of the Court of Justice of the European Union (CJEU) jurisprudence on the harmonization of Albanian legislation concerning commercial companies. Through a rigorous comparative law methodology, this research analyzes how landmark CJEU decisions, particularly the Centros trilogy and subsequent cases, have shaped Albania's commercial law framework during its European Union accession process. The study reveals that Albanian commercial law has undergone substantial transformation, achieving remarkable convergence with EU standards while maintaining certain national adaptations. The analysis demonstrates that CJEU jurisprudence has influenced Albanian law both directly through explicit legal reforms and indirectly through the transformation of legal culture and regulatory approaches. Key findings indicate that Albania has successfully implemented the principles of freedom of establishment, mutual recognition, and administrative simplification, positioning itself as a model candidate for EU accession.
