A valótlan tényállítások megítélése a választási kampányban - Kitekintő a kapcsolódó joggyakorlatra
Freedom of public discourse must be given particular prominence during election campaigns, and restrictions on the statements made by competing candidates can only be constitutionally justified in exceptional cases. Different standards apply to value judgements and statements of fact, but neither category can be considered completely unrestricted. Just as opinions that violate human dignity are not protected, in certain cases false statements of fact do not either. The paper reviews the constitutional aspects of communications falling into the latter category and the relevant decisions of case law based on the law on electoral procedures.
