The regulatory and legal framework for social support for children affected by military actions
In the article, the analysis of the regulatory and legal framework for social support for children affected by military actions allowed us to identify four interrelated areas of legislative support: 1) international legal standards for ensuring the rights of the child (universal principles for protecting the rights of the child); 2) national legislation in the field of social and legal protection of children (the legislation of Ukraine, which determines the mechanisms of state assistance); 3) legal regulation of the educational sphere in the context of social protection of children (creation of conditions for the development, education, socialization of children); 4) health and rehabilitation norms for the formation of conditions for the development and socialization of children (creation of conditions for socialization and restoration of children's health). Such a structure indicates a comprehensive approach of the state to ensuring the rights and needs of children, but at the same time reveals a number of contradictions and gaps that complicate the effectiveness of the implementation of legal mechanisms. In particular, the task of integrating international standards into national legislation, improving regulatory and legal mechanisms for social protection, reforming the education sector and optimizing health and rehabilitation programs is urgent. There is no universal legal document capable of comprehensively resolving all issues of children affected by military actions. The state is forced to combine various support instruments - from material assistance to the creation of a system of social, educational and health and rehabilitation services. It has been established that improving the system for ensuring the rights of children affected by military actions in modern conditions is possible provided that a comprehensive approach is applied, interdepartmental coordination is strengthened and changes in the regulatory and legal framework are constantly monitored in accordance with new social challenges, which will increase the effectiveness of existing protection mechanisms and create a flexible system of legal regulation that can meet the real needs of children during armed conflict and recovery.
