ABANDONO AFETIVO INVERSO: QUANDO OS PAIS SÃO NEGLIGENCIADOS PELOS FILHOS

The scientific article addresses the theme of reverse affective abandonment, characterized by the neglect of children toward their elderly parents, both emotionally and materially, a growing phenomenon in the face of population aging and changes in family dynamics. The study aims to analyze the legal protection of the elderly within the context of family law, examining the legal obligations of children and the role of the State when the family fails in caregiving, using a qualitative and exploratory methodology that includes bibliographic research, legislative and jurisprudential analysis, and statistical data on the situation of the elderly in Brazil. It highlights the negative impacts of this abandonment on the physical and mental health of the elderly, such as depression and social isolation, and emphasizes the importance of the legal foundations established in the Federal Constitution, the Civil Code, and the Elderly Statute, which impose family responsibility and enable civil liability for negligent children. The article also discusses the balance between family autonomy and state intervention, proposing the need to strengthen public policies and social awareness to ensure dignified aging and effective protection of the rights of the elderly, evidencing a humanized and critical approach to the legislation and current judicial practices in combating this type of family neglect.
