Vahid məhkəmə təcrübəsinin formalaşdırılmasında elektron ədliyyə və hüquqi informasiya sistemlərinin rolu

This article provides an in-depth analysis of the role of e-justice and legal information systems in the formation of unified judicial practice. Ensuring the unity of judicial practice is one of the key conditions for the implementation of the principles of a rule-of-law state, particularly the principles of legal certainty and the predictability of judicial decisions. The introduction of digital technologies and the development of electronic platforms in the judiciary not only reduce administrative burdens but also create conditions for the open and timely publication of court decisions in a standardized, unified format. The article elaborates on the concept of e-justice, its necessity, and its development prospects in modern practice. Using international experience (the PACER system in the USA, the ECLI coding model in the European Union, and the HUDOC database of the European Court of Human Rights) as examples, it demonstrates that the full and timely publication of court decisions significantly contributes to the development of precedent law and strengthens the unity of judicial practice. The article assesses the current situation of electronic legal information systems in Azerbaijan, including the “Electronic Court” project, the Supreme Court’s official electronic databases, and other legal information platforms. Special attention is given to minimizing regional discrepancies, ensuring that decisions are published in full rather than selectively, and improving filtration and precedent search tools. The author puts forward concrete proposals to enhance technical infrastructure, implement a unified coding system similar to ECLI, develop human resources, and expand international cooperation. Ultimately, the effective application of e-justice will strengthen legal certainty, increase public confidence in the judiciary, and ensure the predictability and consistency of judicial practice. Keywords: unified judicial practice, precedent law, e-justice, legal information systems, legal certainty, access to court decisions, regional consistency, court registers.
