Dövlət immuniteti barədə Azərbaycan Respublikasının qanunvericiliyinin mövqeyi və inkişaf meyilləri

The article examines the subject of international private law and the characteristics of the Republic of Azerbaijan’s participation in such relations. International private law is distinguished by the presence of a foreign element in civil transactions, including property, family, and labor relations. This foreign element may manifest in the subject, object, or legal fact of the relationship. The Republic of Azerbaijan legislation allows the state to participate in civil law relations akin to other legal entities. The legal basis for this participation includes the Civil Code, the Law “On International Private Law” and international treaties. State immunity is a significant issue in these relations. The Republic of Azerbaijan is primarily active in economic, trade, energy, and investment spheres. Concession agreements, production-sharing agreements, and investment contracts strengthen the state’s role in the economic domain. International documents, particularly the Vienna Conventions and investment-related acts, reinforce The Republic of Azerbaijan’s legal framework. Ultimately, the Republic of Azerbaijan acts as a fully-fledged subject of international private law within the frameworks of national legislation and international legal norms. Keywords: civil transactions, investment relations, state immunity, Republic of Azerbaijan, international private law, foreign element.
