Kosmos hüququnun Türkiyə və Azərbaycan perspektivindən dəyərləndirilməsi
The article examines the legal aspects of the development of space law in Turkiye and Azerbaijan within the context of international and national frameworks. Key international treaties, including the 1967 Outer Space Treaty, the Convention on the Registration of Objects Launched into Outer Space, and the Convention on International Liability for Damage Caused by Space Objects, are critically analyzed. National regulatory mechanisms, such as the activities of Turkiye’s Space Agency (TUA) and Azerbaijan’s “Azercosmos” Agency, as well as the characteristics of licensing policies and oversight of private space initiatives, are thoroughly assessed. Particular focus is placed on jurisdictional issues, the liability of states and private operators, the protection of intellectual property, and the role of bar associations in the enforcement of legal practices. The necessity for the alignment of national legislation with international standards, especially in the areas of commercial space utilization and the regulation of private sector involvement, is underscored. The findings highlight that effective legal regulation must ensure a balanced relationship between state control and commercial activities, thereby creating favorable conditions for the promotion of innovative development. The refinement of legislation is anticipated to enhance the positions of Turkiye and Azerbaijan in international space endeavors and broaden their participation in global space exploration initiatives.
