Öhdəliyin icrası haqqında iddiaların digər iddia növlərindən fərqli cəhətləri
The article examines the institutions of the claim for enforcement, the claim for annulment, and the claim for performance within administrative procedural law from a comparative legal perspective. Using the examples of German, Azerbaijani, and Turkish legislation, the legal nature, subject matter, scope of application, and procedural features of these claims are analyzed. In German law, the claim for enforcement is classified within the group of enforcement claims and is subdivided into “action against refusal” and “action against inaction”. In Azerbaijani legislation, while the claim for enforcement is aimed at ensuring the adoption of an administrative act, the claim for performance applies to the execution of actions of a factual nature. In Turkish legislation, these claims are not classified separately but are regulated within the framework of the “full jurisdiction action”. The study also explains the legal regime of administrative contracts, the circumstances under which they may be concluded, and the possibilities for judicial review in the context of the “separable act” theory, including the determination of the type of claim that may be brought before a court concerning administrative contracts. In conclusion, it is argued that clearly defining the boundaries between claim types has an impact on administrative judicial proceedings, and proposals are made for the improvement of the legislation. Keywords: claim for the performance of an obligation, administrative court procedure, deadline, claim for enforcement, administrative act.
