This article studies the evolution of the doctrine of the Spanish Constitutional Court on conscientious objection in the health field, from the first ruling issued by the Court in 1985 to the last in 2024. Each and every ruling that has addressed freedom of conscience in the health field is discussed and the different stages through which the Court has passed and the contradictions in which it may have incurred are highlighted, and how they have been glossed by scientific doctrine. It also takes advantage of the opportunity to study the legislative policy that has been developed over this time, in matters that di rectly affect people’s conscience, and how these policies have evolved and how they have been sheltering new fundamental rights. From all this, it is concluded that neither the Constitutional Court has been able to specify the legal nature of conscientious objection nor scientific doctrine either.
