The religious freedom of minors has become an increasingly important issue in the legal field, particularly within the family context, where the complexity of interactions between the rights and duties of parents and those of children is evident, especially concerning their autonomy or capacity to exercise their rights, all within the framework of the best interests of the child. This paper will focus on the current situation regarding the right to reli gious freedom of minors as manifested in its most genuine context: the family. Specifically, it will address situations where discrepancies arise regarding the education of children. We will begin with a brief exposition of the legal status of minors, emphasizing the most relevant regulations of recent years, which have shown a general trend towards relaxing the maturity criteria necessary for minors to exercise their rights. In this regard, we consider it relevant to outline some ideas on four essential aspects to understand the religious freedom of minors: 1. The complex theoretical framework related to the capacity of minors to exercise their rights; 2. The best interests of the child; 3. their interrelation with parental rights; and 4. The intervention of the State in the protection of minors and their rights. This theoretical approach will serve as a basis for the second part of this paper, which will consist of an analysis of the most recent and significant court rulings regarding the religious freedom of minors, with the aim of detecting the current interpretative line upheld by both the Spanish Constitutional Court and the European Court of Human Rights concerning the religious freedom of minors, as well as how the criteria of maturity and the best interests of the child are applied in these cases.

The religious freedom of minors has become an increasingly important issue in the legal field, particularly within the family context, where the complexity of interactions between the rights and duties of parents and those of children is evident, especially concerning their autonomy or capacity to exercise their rights, all within the framework of the best interests of the child.
