Digitalization has entered every aspect of modern society. The penetration of modern technology has made it possible to resolve certain situations and procedures in an easier, faster and higher quality manner. In the paper itself, the author deals with the very important issue of the use of modern digital evidence in criminal proceedings. Digital evidence and its use are becoming increasingly relevant, given the increase in crimes committed through the misuse of modern technologies, as well as the fact that modern technology is increasingly used in the commission of incriminated acts related to criminal acts. The starting hypothesis of the paper is that the state and society must confront the challenges of digitalization as effectively as possible. High-tech crime is the crime of the future, and modern digital evidence must be included in the evidentiary procedure conducted in connection with criminal proceedings.
