Formation of the Space Tourist Legal Status in Russia
The first space tourist flight took place in 2001. Space tourism has been developing due to the transformation of space infrastructure and the growing number of super-rich people. Meanwhile, Russian national space law does not provide the concept of a space tourist, does not establish requirements for his personality, does not consolidate rights and obligations. Research methods: general scientific methods, as well as systemic and logical analysis of scientific literature and norms of Russian and international legislation, the method of comparative law. The goals and objectives of the study are to determine the legal status of a space tourist; to formulate the necessary changes in legislation. The definition of a space tourist is substantiated, which is understood as an adult Russian or foreign citizen who is provided with a set of services for medical examination of the compliance of his health condition with an orbital flight, preparation for the flight, the flight itself, stay on the space station, spacewalk, and return to planet Earth. The main responsibilities of a space tourist are formulated: to undergo selection based on medical indications; to master special training that increases the tourist’s adaptation to flight conditions; to obey the orders of the crew commander; to pay for the tourist product. Problems have been identified in connection with the application of the space tourist’s right to flight safety, the right to quality service, the right to information about the rules of conduct on board a spacecraft, about changes in health after the flight; the right to choose activities on board a spacecraft within the scope of the tourist service and the guaranteed level of safety; the right to a medical examination, physical and mental recovery of the body after the flight.
