A JUDICIALIZAÇÃO DA SAÚDE E OS IMPACTOS NA EXECUÇÃO ORÇAMENTÁRIA MUNICIPAL
This article analyzes the impacts of health judicialization on the municipal public budget, considering the growing number of court decisions that require local governments to finance medications, treatments, and medical supplies. It is argued that, although judicialization is a legitimate instrument for accessing rights, it creates imbalances in budget management and weakens public policy planning. Through bibliographic review, document analysis, and case study, the article presents administrative and legal strategies adopted by municipalities, such as regulatory decrees and technical support units for the Judiciary. It concludes that mitigating the negative effects of judicialization requires the institutionalization of intersectoral practices and the strengthening of federal cooperation.
