Căn cứ xác định người khởi kiện trong tố tụng hành chính Việt Nam

The grounds for determining serve as the basis for the Court to establish the plaintiff’s qualification and provide the essential premise for agencies, organizations, and individuals to participate in judicial proceedings, with the objective of protecting legally recognized rights and interests that have been infringed upon by state administrative actions. This article clarifies theoretical issues concerning the grounds for determining plaintiffs, analyzes the provisions and limitations, and inadequacies in the regulations of the 2015 Law on Administrative Proceedings (as amended in 2019 and 2025) regarding the grounds for determining plaintiffs, thereby proposing recommendations to improve provisions on the grounds for determining plaintiffs in Vietnamese administrative proceedings.
