Compensation for moral damage in land disputes in procedural and substantive law: theoretical aspects, judicial practice and development prospects

The authors investigate the theoretical and empirical aspects of compensation for moral damage arising from land disputes regulated by the Russian civil legislation and judicial practice. The conditions of bringing to justice, the facts that need to be established in order to receive compensation, as well as the criteria determining the amount and forms of indemnification with a specification of the evidentiary process are considered in this paper. As a part of the analysis of judicial practice, the need to identify priority areas of legal regulation in this sphere is underlined by the authors as well.
