MENUJU TATA KELOLA PEMERINTAHAN YANG BAIK: TELAAH KRITIS ATAS PENANGANAN PENGUNGSI DI INDONESIA
The enactment of Presidential Regulation No. 125/2016 about the overseas refugee handling does not guarantee optimum refugee handling in Indonesia. Despite the existing legal framework, recent events, such as the rejection of Rohingya migrants in early 2024, emphasize the need for a thorough examination. This paper perform a critical analysis of refugee handling in Indonesia using qualitative-descriptive analysis method, based on the provisions of laws and regulations, the findings of previous studies, and news both in national and international level. The analysis is conducted using the principles of good governance, which include legal clarity, expediency, impartiality, correctness, non-abuse of authority, openness, public interest, and quality service. The findings indicate that the chaotic management of refugees in Indonesia lies in the inconsistency of regulations related to the handling of refugees, differences in interests among the parties involved, and public perception. This article emphasizes the need for stakeholders to gather to discuss refugees, refugee rights, government obligations, and, most significantly, how the government responds to their presence.
