O mal-estar na Justiça: entre demanda e desejo
This article addresses the contribution of Psychoanalysis to the Justice system. Family conflicts are analyzed, especially with regard to the place of the child in the face of their parent’s malaise. Families that seek the Judiciary begin to live, based on judicialized parental ties, in which the word is worn out and dominated by judicial procedures. Contradictions and impasses in the subjective position of the parents are present, which can aggravate the conflicts. Children and adolescents are subjected to the unresolved marital remains of their parents, becoming objects in this family dynamic. Concomitantly, families have had difficulty in conducting parental exercise, through authority, allowing their children to decide. It is known that it is not up to the Justice system to establish parental functions, however, through Psychoanalysis, it is possible to touch on the singularity of the subjects that present themselves. The aim is to identify and give consistency to the desire underlying the various demands that arise from family conflicts, making the subject emerge from the unconscious in consonance with the subject of rights.
