TEN PROPOSALS FOR IMPROVING THE LEGISLATION ON NOTARIES

The Russian notary, being an important element of the legal system of the state, plays a key role in regulating social, economic and legal relations. Currently, there is a discussion about the need to adopt a “new” law on notaries, which would replace the current Foundations of the Legislation of the Russian Federation of 1993. Representatives of the Russian Ministry of Justice advocate significant changes, including expanding the powers of the subjects of the Russian Federation, strengthening state control and increasing requirements for notaries. At the same time, the Federal Chamber of Notaries insists on maintaining the current model, emphasizing its effectiveness and progressiveness. The article suggests initiatives to improve legislation, the adoption of which is possible without the need to issue a “new” federal law to replace the Basics of legislation on notaries. The author calls for an evolutionary rather than a revolutionary approach to notary reform, in his opinion, this will help maintain the stability of the legal system and avoid law enforcement problems.
