Legal Review of Compensation Responsibility by PT Kereta Api Indonesia (Persero) to Passenger Accident Victims
This study aims to examine how PT Kereta Api Indonesia (Persero) is responsible for paying compensation to passengers who are victims of accidents. The main focus is on the legal position of PT KAI, its responsibilities, and how settlements must be carried out in accordance with the laws and regulations. Law Number 23 of 2007 concerning Railways and the Civil Code are some of the laws used in this study. A study shows that PT KAI, as a private railway company, has a legal responsibility to ensure the safety of passengers during the trip. The responsibility for compensation due to accidents is absolute, without the need to prove fault. Responsibility includes death benefits, medical expenses, and compensation for disability or injury. However, administrative problems, ineffective compensation processes, and limited information to victims often prevent these responsibilities from being carried out. As a result, it is necessary to improve PT KAI's internal system to make the compensation process faster, easier to understand, and more beneficial to victims.
