FULL ADMINISTRATIVE CYCLE IN THE ENVIRONMENTAL MILITARY POLICE-MS-BRAZIL, FOR LEGAL, TECHNICAL CAPACITY AND PRINCIPLES OF PUBLIC ADMINISTRATION
The Military Police, through specialized units, represents the largest vehicle for environmental inspection and protection in Brazil, being present in all states and the Federal District, with a greater number ofpersonnel dedicated to inspection. Typically, during preventive actions, several incidents are forwarded to the three levels: criminal and administrative law and the technical reports prepared are used by the Public Ministry Office, mostly to propose to the offender a Conduct Adjustment Agreement (TAC) for recovery or compensation for environmental damages, or a Public Civil Action (ACP). Some do not require a Civil Inquiry due to the quality of the evidence presented. Only 13 states execute environmental administrative infraction reports, and they are issued using documents from the environmental management agencies of each federative unit and only one state executes them using its own reports and adjudicates them. This hinders oversight due to the time and space required for travel and adjudication, as well as potential statutes of limitations with economic and environmental consequences. The problem question is: does the Military Police of Mato Grosso do Sul have the legal and technical competence to execute the Complete Environmental Administrative Cycle? Using a qualitative, bibliographical, and exploratory approach, this work aimed to analyze the legal and technical competence of the Environmental Military Police of Mato Grosso do Sul to execute the Complete Environmental Administrative Cycle, concluding that there are three competencies and an urgent need, in respect of the principles of public administration, in particular, efficiency, effectiveness, productivity, saving of revenue, and celerity, which are fundamental for better environmental protection, greater punishability, and consequently greater deterrence of offenders from committing offenses.
