O PAPEL ESTRATÉGICO DA ADVOCACIA CONSULTIVA NA ESTRUTURAÇÃO JURÍDICA DE STARTUPS DE SEGURANÇA NO BRASIL

This article presents a critical analysis of the strategic role of consultative lawyers in the legal structuring of startups operating in Brazil’s security sector. These companies, subject to strict regulatory frameworks involving public security laws, data protection, civil liability, and sector-specific oversight, require a legal approach that goes beyond formal compliance. The legal advisory function is understood as a structuring element for business viability and long-term sustainability. The study adopts a qualitative and exploratory methodology, based on bibliographic review and regulatory document analysis. It discusses the main legal risks faced by startups in sensitive sectors and highlights good practices found in companies with ongoing legal consultancy. The research demonstrates that consultative legal practice plays a central role in risk mitigation, governance strengthening, and institutional consolidation, actively contributing to responsible, secure, and regulation-aligned innovation.
