Artistic Creation and Copyright in the Age of Artificial Intelligence: A Critical Review of the Need to Reframe Human Ownership in Response to Technological Advancement
This study explores the necessity of reexamining the attribution of authorship, traditionally regarded as an exclusively human domain, in the era of Artificial Intelligence (AI).As AI technologies increasingly encroach upon creative production, particularly in the visual arts, longstanding assumptions about authorship, originality, and intellectual property are being fundamentally challenged. This paper focuses on the intersection of artistic creation and copyright, critically analyzing the emerging legal and conceptual issues surrounding AI-generated works.Drawing upon a historical review of copyright's evolution and case studies from AI-leading countries, the study investigates how the absence of clear attribution standards affects both creators' rights and the advancement of innovation. In particular, it emphasizes the growing gap between existing legal frameworks and the realities of AI-driven content creation.Rather than proposing a definitive legal solution, this study adopts a theoretical and literature-based approach to highlight the importance of redefining ownership in light of shifting perceptions. It argues that copyright discourse must move beyond human-centered assumptions to accommodate new forms of creative agency.Ultimately, this research aims to contribute to a deeper understanding of AI-related copyright challenges and to inform future policymaking that balances technological progress, legal clarity, and public perception in a rapidly evolving digital environment.
