Postavení párů stejného pohlaví v evropském a českém mezinárodním právu soukromém
The case law of the European Court of Human Rights and European Union law has evolved in the protection of the rights of same-sex couples, including the obligation of states to ensure legal recognition of their relationships. Czech legislation still allows marriage only between a man and a woman, while the 2024 amendment to the Civil Code introduces a new institution of partnership. This institution grants same-sex couples nearly the same rights as marriage but retains a different label. The Czech legal framework still raises questions regarding the qualification of relationships, particularly in the context of private international law, where partnerships will likely be considered “similar relationships”.
