The criminal interpretation of partner legal relationship raises a number of legal and doctrinal issues. The aim of this paper is to illustrate the role of domestic partnership in criminal proceedings. Through a detailed analysis of two practical cases, the paper will highlight how the legal system deals with the co-existence of domestic partnership and marriage and the plurality of partner status. The authors conclude, on the basis of a legal analysis and an examination of court judgments, that the current legislation contains uncertainties and leads to inconsistencies in the application of the law. In the light of this, they make de lege ferenda proposals to the legislator to clarify the interpretation of the criminal law of the domestic partnership.
