A gyermekvédelemben érvényesülő foglalkoztatási szabályok alkotmányossági vizsgálata

In Decision 3/2025 (V. 29.) AB, the Constitutional Court established that the phrase "no severance pay shall be granted in case of termination of the employment relationship on this legal basis" in point c) of Section 188/F (2) of Act XXXI of 1997 on the Protection of Children and Guardianship Administration is contrary to the Fundamental Law, as it violates Article B) Paragraph (1) of the Fundamental Law, and therefore annulled it. The Court found the legislative intent constitutionally acceptable, which ensures both the professional and psychological suitability of the employed in the child protection system. However, the Constitutional Court did not find any constitutional or legitimate reason for the denial of severance in addition to the termination of the employment status.
