LATVIA'S LEGAL FRAMEWORK IN INTELLECTUAL PROPERTY: ALIGNING WITH INTERNATIONAL STANDARDS AND LESSONS FOR UKRAINE

The article provides a systematic analysis of how Latvian legislation regarding intellectual property (IP) has gradually transformed within the context of European integration. It considers the historical and legal factors that preceded regulatory reforms, along with the main stages of the legislative framework's development, and explores its modernization and digital transformation. It is shown that Latvia's legal reform is based on adapting structurally to meet the requirements of the acquis communautaire. This process involved not only technical harmonization of laws but also a significant revision of enforcement policies. The professional legal community was extensively involved in implementation, both within state agencies and through international doctrinal support, notably via mechanisms of the European Intellectual Property Office (EUIPO) and the World Intellectual Property Organization (WIPO). The study uncovers the historical prerequisites for establishing the IP system in Latvia after independence. It identifies key phases of legal evolution from initial codification to harmonization with the acquis communautaire, followed by subsequent improvements post-integration. This process included elaborating legal procedures, advancing digital transformation, and aligning with European standards. Considerable attention is given to analyzing how European legislation influenced Latvia's model of legal protection for IP. The Latvian model's conceptual completeness, which balances regulatory consistency and institutional effectiveness, is highlighted. Through comparative analysis, the practical value of Latvia’s experience in reforming Ukrainian legislation is demonstrated. At the same time, the unique features of the Ukrainian administrative system and the legal framework concerning copyright, related rights, and industrial property are taken into account. The author's position supports adapting Latvian mechanisms to Ukraine’s legal context, considering national specifics. The study’s findings can serve as a theoretical and methodological foundation for further legislative updates in Ukraine’s intellectual property protection and for developing a cohesive regulatory strategy within the scope of European integration.
