LEGAL REGULATION OF INDUSTRIAL PARKS IN UKRAINE UNDER MARTIAL STATE: CHALLENGES, GAPS AND PROSPECTS FOR DEVELOPMENT
The article examines the legal and regulatory framework governing the establishment and functioning of industrial parks in Ukraine. It analyzes the content and structure of the Law of Ukraine “On Industrial Parks,” the Strategy for the Development of Industrial Parks for 2023–2030, relevant Cabinet of Ministers’ decrees, recent legislative developments in the field, and comparable EU practices. The current state and dynamics of industrial park creation and operation in Ukraine are explored. Particular attention is given to key components of the organizational and legal mechanism, including tax and customs incentives, investment attraction specifics, as well as legal shortcomings and inconsistencies that hinder the development of industrial parks at both national and local levels. The article emphasizes the need to: optimize administrative procedures related to the registration and deregulation of industrial parks in Ukraine; ensure legal clarity regarding the status of industrial park participants; introduce public-private partnership tools for implementing integrated infrastructure projects within the parks; implement effective state incentives for the establishment and functioning of industrial parks; and align land legislation with the interests of industrial development. The study concludes that efficient legal regulation of industrial park development in Ukraine is crucial for economic growth, regional resilience, and the country’s effective post-war recovery.
