HUMAN RIGHTS IN CONFLICT CONDITIONS IN THE CONTEXT OF EU LEGISLATION AND UKRAINIAN LEGISLATION

The article examines the key aspects of ensuring human rights in armed conflicts in the context of European Union legislation. It is emphasized that human rights, as universal and inalienable, do not lose their relevance even in times of emergency, including armed conflicts. The author analyzes the EU legal framework in the field of human rights protection, in particular fundamental documents such as the Charter of Fundamental Rights of the European Union (2000), the European Convention on Human Rights (1950) and the relevant case law of the European Court of Human Rights. It is noted that although the EU as an organization is not a party to the Geneva Conventions, EU Member States are obliged to comply with the norms of international humanitarian law, including the protection of civilians, the provision of medical care and the prohibition of torture. Particular attention is paid to the mechanisms of the European Union's control and response to human rights violations during conflicts both on the territory of the member states and beyond. The instruments of sanctions policy, human rights observation missions, assistance programs and measures within the framework of the Common Foreign and Security Policy (CFSP) are considered. The article also outlines cases of EU involvement in conflict resolution in regions such as the Balkans, Ukraine, and Syria, where human rights are systematically violated. The author emphasizes the importance of integrating international legal standards for the protection of human rights into the internal policies of the EU, in particular through mechanisms of prevention, monitoring, and accountability. Emphasis is placed on the need to strengthen the role of EU institutions in the protection of human rights in conditions of hybrid and frozen conflicts. The conclusions note that effective protection of human rights during conflicts requires both coherence of the policies of the member states and active use of the potential of the EU as an international actor.
