OWNERSHIP POLICY REGARDING MUNICIPAL ENTERPRISES, INSTITUTIONS AND ORGANISATIONS AND ITS ADMINISTRATIVE AND LEGAL ASPECTS

This article is devoted to the problematic aspects of ownership policy regarding communal enterprises, institutions, and organizations, clarifying its general characteristics and administrative-legal aspect. It is noted that despite the significant number of communal enterprises, institutions, and organizations, which exceeds the number of state-owned ones, and the presence of numerous problems accompanying their activities, examples of the implementation of ownership policies, both at the national (governmental) and local (municipal) levels, for such entities are currently absent. It is determined that the ownership policy regarding communal enterprises, institutions, and organizations should be two-tiered – including national (governmental) and local (municipal) levels. The national (governmental) ownership policy should comprehensively define the general principles of managing the aforementioned communal property objects and substantiate the exclusivity of the relevant communal ownership, while the local (municipal) policy should specify the management principles, including justifying the expediency of retaining them in the ownership of territorial communities, defining the goals and main directions of activity, and outlining the role and functions of local self-government bodies as owners. It is proposed to divide local (municipal) ownership policies based on their scope of application into general (for all enterprises, institutions, and organizations owned by the respective territorial community) and individual (for a specific enterprise, institution, or organization). It is concluded that the administrative-legal aspect of the ownership policy regarding communal enterprises, institutions, and organizations lies in the fact that it should exist in the form of a subordinate regulatory legal act (have formal expression) and, accordingly, be a measure of targeted administrative-legal regulation in the field of managing communal property objects, carried out by authorized central executive bodies and local self-government bodies.
