FEATURES OF ADMINISTRATIVE AND LEGAL PROTECTION MEANS OF PERSONS WITH DISABILITIES AS A RESULT OF THE WAR
The article reveals the key aspects of administrative and legal protection of persons with disabilities as a result of the war in Ukraine, focusing on the specifics of the use of administrative and legal means in modern conditions. As a result of the full-scale armed aggression against Ukraine, the number of citizens who have become disabled as a result of injuries, contusions or psychological trauma has significantly increased. This, in turn, creates an additional burden on the state system of ensuring the rights, social adaptation and integration of such persons. In this context, there is a need to rethink and improve administrative and legal mechanisms aimed at their protection. It is noted that the effective functioning of administrative and legal remedies is possible only under conditions of a clear regulatory framework, proper institutional support, as well as interaction between executive authorities, local governments, social services, public organizations and international partners. The author analyzed the current legislation, in particular the provisions of the Law of Ukraine “On the Status of War Veterans, Guarantees of Their Social Protection”, the Code of Ukraine on Administrative Offenses, the Law of Ukraine “On the Fundamentals of Social Protection of Persons with Disabilities in Ukraine” and other acts that determine the scope of guarantees for persons in this category. Attention is focused on such means of administrative and legal protection as: appeal to state authorities and local governments, appeal against actions or inaction of public administration bodies, protection of rights through the Verkhovna Rada Commissioner for Human Rights, participation in state support and adaptation programs. The shortcomings in the implementation of such means are separately outlined, in particular - bureaucratization of procedures, lack of specialists, insufficient digitalization of administrative services and weak institutional capacity of individual territorial communities. In conclusion, it is noted that the current state of administrative and legal protection of persons with disabilities as a result of war requires a comprehensive update of approaches focused on dignity, social inclusion, equality of opportunities and respect for human rights in accordance with the standards of international law.
