THE LEGAL IMPACT OF SURROGACY TECHNOLOGY BETWEEN INDIVIDUAL RIGHTS AND SOCIAL VALUES
he issues of the era and its rapid development in all fields have become a wide debate among those interested in religious, ethical and legal matters, and one of the most prominent areas that have taken on a thorough research character is in the field of Medicine in general and the issue of reproduction and infertility treatment in particular.Perhaps the most notable achievement of the field of Medicine and biology in the fight against infertility is artificial insemination, a technique that has achieved a lot for the individual and society, and this technique has developed and has several branches and forms, including what is religiously and morally acceptable and what is rejected.Among its branches that have sparked controversy between support and opposition is the surrogate mother technique (rented uterus), the latter is one of the contemporary legal and ethical issues that defined the intersection between individual rights and social and religious values prevailing in different societies. While some consider it a legitimate way to help individuals who are unable to procreate, others believe that it raises social, ethical and legal problems.inthis context, this study aims to find out the legal impact of the surrogate mother technique between individual rights and social values, while analyzing a range of issues raised by this technique, and highlighting the social, ethical and religious challenges it faces.I will discuss achieving a fair balance between individual rights and respect for societal values, to arrive at several proposals aimed at developing a legal and ethical framework that takes into account the complexities brought by this technique.
