Krivičnopravna odgovornost u trgovini digitalnom imovinom na tržištu kapitala

This paper analyzes criminal liability in the field of digital asset trading on the capital market, with a focus on the increasingly frequent abuses such as money laundering, market manipulation, terrorism financing, and investment fraud. It highlights the insufficient normative alignment of existing criminal and capital market regulations, both in the Republic of Serbia and in the broader international context. Special emphasis is placed on the role of regulatory authorities and international institutions, as well as the challenges related to the implementation of existing legal provisions. The aim of this paper is to identify, through systematic legal analysis and a comparative approach, the critical shortcomings in the current system of market protection and sanctioning of abuses. Particular attention is devoted to the role of institutions such as the Securities Commission, the National Bank of Serbia, judicial authorities, as well as international bodies such as INTERPOL and Europol. This study is intended for experts in the fields of criminal and financial law, regulators, policymakers, and the academic community, with the goal of providing a systematic insight and encouraging concrete measures for a timely and effective response to the risks associated with digital assets.
