Balancing Privacy and Innovation: Analyzing the DPDP Act, 2023 in India’s Cyber Law Framework
The Digital Personal Data Protection Act, 2023 (DPDP Act) marks an important development in India's automobile toward a robust data protection law, aiming to guarantee individual privacy while supporting a data-driven digital economy. This paper critically examines the DPDP Act's function in balancing the competing demands of personal data protection and technological innovation within India's expanding cyber constitutional situation.By studying the Act's provisions, such as consent mechanisms, obligations of data fiduciaries, and the establishment of the Data Protection Board, the study assesses its compatibility with international norms like the GDPR and its precursor, the Information Technology Act, 2000.It addresses challenges in implementation, including enforcement procedures, cross-border data transfers, and the Act's influence on developing technologies. The report emphasizes potential tensions between privacy regulations and the needs of India's expanding tech economy, suggesting proposals for a harmonized framework.Through a doctrinal and comparative approach, this study underlines the DPDP Act's revolutionary potential and its limitations in establishing a secure, innovative digital economy.
