Kajian Kriminologi Tindakan Hate Speech Akun Fufufafa dan Penerapan Hukum Pidana

Abstract. The advancement of information and communication technology has given rise to the cyber era, transforming the way society interacts, including how individuals express their opinions on social media. This has given rise to the phenomenon of hate speech, often conveyed anonymously and with serious psychological and social impacts. Although hate speech is regulated under the UU ITE and KUHP (UU No. 1 Tahun 2024), law enforcement against hate speech, such as in the case of the anonymous account "Fufufafa," still face significant challenges. Therefore, there is a need for stronger regulations, public education, and improved coordination among law enforcement agencies. This research uses a qualitative method with descriptive analysis through a criminological approach, particularly Differential Association Theory. The analysis was conducted to determine the factors causing the perpetrator of the "Fufufafa" account to commit hate speech on social media and to understand the implementation of applicable criminal law regulations regarding hate speech cases by the "Fufufafa" account on social media. Abstrak. Perkembangan teknologi informasi dan komunikasi telah memunculkan era cyber yang mengubah cara masyarakat berinteraksi, termasuk dalam menyampaikan pendapat di media sosial. Hal ini memunculkan fenomena hate speech, yaitu ujaran kebencian yang sering disampaikan secara anonim dan berdampak serius secara psikologis maupun sosial. Meskipun telah diatur dalam UU ITE dan KUHP yang baru (UU No. 1 Tahun 2024), penegakan hukum terhadap hate speech, seperti pada kasus akun anonim “Fufufafa”, masih menghadapi tantangan sehingga diperlukan penguatan regulasi, edukasi masyarakat, dan koordinasi antarpenegak hukum. Penelitian ini menggunakan metode penelitian kualitatif dengan analisis deskripstif melalui pendekatan kriminologi, khususnya Teori Asosiasi Diferensial. Analisis dilakukan untuk mengetahui faktor penyebab pelaku akun “Fufufafa” melakukan tindakan hate speech di media sosial serta mengetahui implementasi aturan hukum pidana yang berlaku terhadap kasus hate speech oleh akun "Fufufafa" di media sosial.
