Analisis Implementasi Putusan MA Nomor 1027 K/Pdt/2020 Terkait Kepemilikan Tanah: Perspektif Al-Milkiyah dan UU (Studi Kasus di Pasar Sayati Kabupaten Bandung)
Abstract. Land is an important source of human life both economically, politically, culturally, and spiritually. In Islamic law, land does not absolutely belong to humans, but belongs to Allah SWT, humans are only given permission to use it in accordance with sharia principles through legal means such as buying and selling. The concept of Al-Milkiyah is the basis of ownership, however, there are often inconsistencies with Indonesia's positive laws that regulate various land rights. This research will analyze the implementation of Supreme Court Decision Number 1027 K/Pdt/2020 according to the perspective of Al-Milkiyah and the Law. The method used is qualitative with a normative-empirical juridical approach. Primary and secondary data analysis methods from court decisions, interviews with informants and sharia law experts. The results of the study show that even though the court recognizes the trader's ownership rights, the implementation of the decision is still hampered by administrative problems, especially the obstacles from the BPN to issue certificates because the land is still registered as a local government asset. According to the perspective of Islamic law, this delay or inhibition is dzulm (Injustice), while according to positive law or law that reflects weak coordination between institutions so that obstacles occur. This research recommends synergy and bureaucratic reform to ensure that the execution of court decisions runs effectively and prioritizes substantive justice for the community.
