Implementasi Kewajiban Sertifikasi Halal Produk Impor Perspektif Undang-Undang Jaminan Produk Halal Nomor 33 Tahun 2014 dan Fikih Muamalah (Studi Kasus Mie Instan Korea di Kota Bandung)

Abstract. The government has mandated halal certification; however, many imported products, including Korean instant noodles, remain uncertified. The lack of halal certification for these instant noodle products has raised concerns among Muslim consumers due to the uncertainty of their halal status. This study aims to analyze the implementation of the Halal Product Assurance Act (UU JPH) regarding the mandatory halal certification of Korean instant noodles and to examine the perspective of Islamic commercial jurisprudence (fiqh muamalah) on uncertified Korean instant noodles. The research employs a qualitative method with a normative-empirical approach. The findings reveal six Korean instant noodle products, three of which are halal-certified, while the remaining three are non-halal. However, halal and non-halal products are not separated on store shelves, and no sanctions or warnings have been issued to business operators. According to fiqh muamalah, consuming food with uncertain halal status (syubhat) poses a risk of violating the principles of caution and sadd al-dhara’i (preventing harm).
