Research on the Litigation Status of Estate Administrators

This study aims to explore the litigation status of estate administrators. Through an analysis of relevant legal provisions and comparative examination of domestic and international legislative and judicial practices, it clarifies the legal status and litigation capacities of estate administrators. Drawing on theoretical doctrines concerning the legal status of estate administrators—specifically the theory of the right to administration and the theory of litigation undertaking— and integrating judicial practices of China’s estate administrator system, this paper proposes a theoretical foundation and practical pathway for establishing the independent litigation status of estate administrators. The findings provide theoretical support and judicial references for defining the litigation status of estate administrators in China.
